This essay states the archive's constitutional sentence in one place: a system is legitimate only when ordinary people can use its options, protections, and remedies without hidden costs that distort choice, survival, or standing. The rest of the framework should be read as a derivation of that claim rather than as a loose set of adjacent insights.

Systems are defined by the selves they require names the moral lens for judging what kinds of adaptation a system extracts in order to preserve its own calm.

The constitutional order

The first level is foundational. The governing question is whether ordinary people can inhabit a system's options, protections, and remedies without destabilization. Legitimacy does not turn on whether an institution can display procedures in the abstract; it turns on whether recourse is livable in use. A right, appeal, accommodation, complaint path, or exit route is not adequate merely because it can be named. It has to be reachable in time, under ordinary constraints, without consuming the life it is supposed to protect.

The second level is interpretive. Permission is not freedom because formal optionhood can coexist with costs that make use punishing in practice. Non-use is not consent because withdrawal, silence, delay, and low uptake are corrupted forms of evidence whenever people are responding to retaliation, stigma, exhaustion, proof burdens, or economic risk. Institutions often narrate themselves back into innocence by recording the non-use while hiding the conditions that produced it.

The third level is mechanistic. Burden transfer explains how institutions stay orderly by relocating time, confusion, paperwork, risk, emotional regulation, and repair onto people with less power. What looks efficient at the center is often cost exported downward. The deepest mechanism sits one step further in: lived harm has to become recognized harm, then an actionable claim, then a binding obligation. Illegitimate systems interrupt that sequence through invisibility, normalization, delay, proof inflation, retaliation risk, and procedural exhaustion.

The fourth level is moral and anthropological. Systems are defined by the selves they require. If survival inside an arrangement depends on becoming endlessly documentable, strategically silent, cheerful under strain, obedient to ambiguity, grateful for delay, or willing to self-erase in order to remain legible, then those demanded adaptations are not side notes. They are evidence about the structure itself. A system reveals its terms by the kind of person one must become to keep functioning inside it.

The fifth level is political and diagnostic. The framework asks who pays for delay, who absorbs uncertainty, what hidden sacrifice keeps the surface calm, and what happens to a person who actually tries to use the offered remedy. Those questions are paired with an ordinary-person standard: a remedy is usable only if people with ordinary limits—limited time, incomplete information, caregiving pressure, fear of retaliation, fatigue, and ordinary emotional thresholds—can use it without being separately broken by the attempt.

The final level is redesign. Once hidden costs are identified, institutions owe more than better language. They owe redesign: proof burdens shifted upward, retaliation exposure reduced, delay shortened where time compounds harm, uptake conditions treated as the measure of whether a remedy is real, and downstream adaptation counted as a system cost rather than private resilience. That is the constitutional version of the archive's claim: legitimacy fails when institutions preserve an appearance of freedom by shifting the costs of use downward, misreading the resulting non-use as consent, and demanding selves shaped for endurance rather than livable participation.
